Tribunal Decisions Online
Employment tribunal decisions will now be made available online.
The President of HM Courts and Tribunals Service (HMCTS) has confirmed at the National Employment User Group Meeting that as of late 2016/early 2017, employment tribunal decisions will now be made available through an online database. At present, decisions can only be obtained by attending the Employment Tribunal Judgement Register Office located in Bury St. Edmunds.
The facility will be accessible to all stakeholders and users. Judgments can be searched for using a drop down menu and free text search. Users will also be able to enter generic search terms into the free text search, for example “equal pay” which will produce all relevant judgments to the specified search term. Under the new system, judgments will be updated as so required, with the original being replaced immediately. Past judgments will not be accessible on the new system, but can still be obtained by attending the register office in Bury St Edmunds.
The new online database is introduced with a view to facilitating access to tribunal judgments and is part of the Government’s “open justice” initiative which applies to courts and tribunals in England and Wales. Consequences of the decision to make judgments available online is that the tribunal may be left vulnerable to blacklisting and researching into outcomes and patterns, as well as increased potential negative publicity for employers.
